These terms apply to courses, training, examination services and consulting services offered by Blue Aviation GmbH.
§ 1 Scope
These General Terms and Conditions (Terms) apply to all contracts for training, courses, practical training sessions, exam preparation and consulting services concluded between Blue Aviation GmbH (hereinafter "Blue Aviation") and its customers. Any deviating terms of the customer do not become part of the contract unless Blue Aviation expressly agrees to their validity in writing.
§ 2 Contracting Party
The contract is concluded with Blue Aviation GmbH, Schlehdornweg 25, 22335 Hamburg, registered with the Amtsgericht Oldenburg under HRB 220195, represented by Managing Director Marcel Sieben.
§ 3 Conclusion of Contract
The presentation of courses and services on the website does not constitute a legally binding offer, but rather an invitation to place an order. By completing the ordering process, the customer submits a binding offer to conclude a contract. The contract is concluded upon confirmation by Blue Aviation (e.g. a booking or order confirmation by email) or upon activation of the digital course.
§ 4 Prices and Payment
The prices stated at the time of the order apply. All prices include statutory value-added tax. Payment is made via the payment methods offered during the ordering process. For digital courses, access is activated upon receipt of payment.
§ 5 Delivery of Training and Scheduled Sessions
Services tied to a fixed date (e.g. practical training, BOS consulting, Creative formats) are arranged individually. Blue Aviation reserves the right to reschedule appointments for good cause (e.g. weather, safety, staff or airfield unavailability). In such cases, an alternative date will be offered promptly.
§ 6 Withdrawal and Cancellation
For date-bound in-person and practical services, the cancellation deadlines stated in the respective offer apply. Unless otherwise agreed, cancellation free of charge is possible up to 14 days before the scheduled date. The customer's statutory rights remain unaffected.
§ 7 Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal. For contracts concerning digital content not supplied on a physical data carrier, the right of withdrawal expires if the customer has expressly agreed that performance may begin before the withdrawal period has ended and has confirmed their awareness that the right of withdrawal is thereby lost. Complete withdrawal instructions are provided during the ordering process.
§ 8 Liability
Blue Aviation is liable without limitation for damages arising from injury to life, body or health, as well as for intent and gross negligence. In all other respects, Blue Aviation is liable only for breach of material contractual obligations and limited to the foreseeable damage typical for this type of contract. Responsibility for the legally compliant and safe operation of drones in the customer's own use remains with the customer.
§ 9 Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
